Healthy soils and the ecosystem services they provide constitute the bedrock of development and progress for United Nations Member States, and they underpin the welfare and security of present and future generations. With soil degradation, these ecosystem services are not only disrupted—thereby affecting the trajectory of development—but the resulting harms also transcend States’ geographical boundaries and expose global biodiversity and the climate system to serious risks. The central aim of this study is to examine the normative and structural linkages between the right to development and soil protection within the framework of international human rights law. The primary question is how contemporary international law has recognized such a systemic nexus, and what the most significant obligations of United Nations Member States are regarding soil protection under international law.The findings of this research, with particular emphasis on the Advisory ICJ .The findings of this research, with particular emphasis on the Advisory Opinion of the Nations General Assembly resolution requesting the advisory opinion was drafted and adopted in a deliberate and systematically informed manner. A content analysis of that resolution and the Advisory Opinion reveals the structural and normative interconnections among climate change driven by soil degradation, human rights, the right to development, and the protection of the global environment.
